After the accident: Can I do something to save my savings and home?

      Hi Folks, I am very nervous and need advise.

      I was in accident on hwy a month ago in TX. I was at fault and rear ended other car which got damaged from rear. No passengers or drivers were injured. I called police which came in about 45 mins and gave no tickets not even a report. Both cars were drivable , cop said its pretty common. Cop told we can do crash report at any police station if needed. They handed both drivers a blank blue report for it . And just told us to take pictures and exchange DL and insurance pictures.

      I was driving my friend’s car and later my friend’s insurance Company AAA contacted my friend and asked for information about accident , he told what he knew and shared my contact. AAA contacted me later to ask details and just told to share pictures.

      My friend coordinated with AAA for his car fix and paid 750 deductible, total bill was around 2500. Recently I got call from AAA that other driver has a medical attorney and possibly looking to sue for personal injury. I told them he wasn’t injured, AAA told me they will pay any medical bills from personal injury amount, 50k.

      I am very nervous. This is my first time ever in any accident. I have strived hard to save some $$$. AAA hinted they can sue. Can I do something to save my savings and home?

      NOTE: I did pay my friends deductible and plan to cover his premium increase if any.

      This is my first ever accident in 15 years of driving, I have zero tickets. So, I am a responsible driver.

      I agree the injuries can be found later, my intent with the post is to get inputs on how can I save my savings incase I get sued.

        I’ve been in a similar situation – my son had a minor collision, no injury (on my insurance).

        In his case scammer on the other side saw chiropractor 2x a week fir months. Ran up $10k bill and got $20k on top for “pain and suffering”.

        No way of telling if this is a scam or genuine.

        But the $50k policy limit should be easily sufficient for *this* kind of situation.

        But $50k coverage is woefully inadequate fir anybody with any assets at all.

        Get an umbrella policy ASSP (won’t help you here). They will require sensible liability cover on auto and homeowners.

        This could be the wake up call you needed to protect yourself from something much more serious

          Realistically you should be covered because your insurance will kick in to cover what theirs won’t. But honestly it’s also unclear because there’s not enough information here to tell us.

          You need to know both policy limits and you don’t say if anyone has an umbrella policy.

          Insurance only covers up to the limit. There could be lost wages for the other party even with a minor accident.

          I will say it’s VERY RARE for there to be no after effects the day or two after being rear-ended. Besides whiplash, forearms holding the steering wheel and the right side of the body (especially foot ankle and shin) absorb the impact.

          People can walk away feeling fine and wake up sore with some numbness or tingling the next day.

          I’m not saying their aren’t frivolous lawsuits but the accident adrenaline can mask a lot too. It would be strange for them to need to sue you personally. I would make sure the insurance companies remain involved.

            This happened to me. I got into a 10 mph fender bender, and they sued. Insurance took care of everything. They will make you fill out a financial affidavit.

              I had a similar situation but only going 15 mph. The other person sued just to take advantage of the situation. My insurance company (Geico) at the time paid her $20,000 just to have her go away.

              The original letter from the attorney wanted several hundred thousand that said she could barely walk or bathe. It was crazy because she was not hurt. She got out of her car quicker than I did and then called 911 to get herself checked. They told she was fine. Again, it was a 15mph accident that barely touched her car as we were waiting for the light to change. The insurance company said that they had to settle on something.

                First off…let’s not forget that YOU were at fault. Not them. So you accusing them of a fake suit is BS in my opinion. Take responsibility. Sometimes injuries show up later….not immediately after the incident.

                Secondly….you said AAA said they’d pay all the medical bills….so what’s the problem? Are you thinking they might want more than just their medical bills paid? It’s possible. That’s why an umbrella policy is so important. Your home owners insurance should cover you too if you have one.

                But that all said, stay calm and see what they want first. Don’t jump the gun and worry unnecessarily. Sht happens. Not the end of the world

                  Even if you get sued, Insurance will cover everything except the deductible.

                  No court will come after your money, house, or car.

                  It doesn’t work like that.

                  Attorneys want the insurance companies money, not yours.

                    But, poster has a right to be nervous, he’s worried there will be a false lawsuit. Hopefully, the victim has minimal injuries (and yes, they can show up later). AAA says, they’ll pay the medical bills, which they should, that’s why you have insurance, so hopefully everything is ok. And, now you‘ll be more careful driving, and avoid a really serious accident.
